These Terms of Service ("Terms") govern your use of yourfamilyinsured.com (the "Site"), operated by FamilyInsured ("we," "us," "our"). By using the Site or submitting information through it, you agree to these Terms.
1. What we do
FamilyInsured is a private insurance referral service. We help consumers find final expense whole-life insurance coverage by connecting them with licensed independent insurance agents and licensed insurance carriers. We are not an insurance carrier, not affiliated with any government agency, Medicare, Social Security, or any specific carrier, and we do not issue insurance policies.
2. Eligibility
You must be at least 18 years of age to use the Site and request a quote. Insurance products offered through the Site are available to adults; eligibility varies by product and state. Coverage is available in 49 states; residents of New York are not eligible at this time.
3. No guaranteed approval, rate, or coverage
Submitting a quote request does not guarantee approval for any insurance policy, any specific premium, or any specific coverage amount. Rates, eligibility, and coverage are subject to underwriting by the issuing carrier and may vary based on your age, state of residence, health profile, and other factors. The agent you speak with will provide details specific to your application.
4. TCPA consent
By submitting a quote form with your phone number and checking the consent box, you provide your prior express written consent to receive telemarketing calls, text messages, and pre-recorded messages from FamilyInsured and one or more licensed insurance agents or partners, including via automated technology. This consent is not a condition of purchase. You may revoke consent at any time by following the opt-out instructions in our Privacy Policy.
5. SMS / text messaging terms
If you opt in to receive text messages, the following terms apply:
- Program description: you will receive text messages related to your insurance quote request, including follow-ups from licensed agents and account or appointment notifications.
- Message frequency: message frequency varies based on your interaction with us.
- Cost: Msg & data rates may apply, charged by your wireless carrier.
- Opt out: reply STOP to any message to unsubscribe at any time.
- Help: reply HELP for assistance, or email support@yourfamilyinsured.com.
- Carrier disclaimer: carriers are not liable for delayed or undelivered messages. Supported carriers may vary.
6. Information accuracy
You agree to provide accurate, current, and complete information on the Site. Providing false information may result in inability to obtain coverage or, in cases of insurance fraud, denial of claims by the carrier.
7. Intellectual property
All content on the Site — including text, graphics, logos, and the FamilyInsured name — is owned by FamilyInsured or its licensors and is protected by U.S. and international copyright and trademark laws. You may not reproduce, distribute, or use any content without written permission.
8. Disclaimer of warranties
The Site is provided "as is" and "as available," without warranties of any kind, either express or implied. We do not warrant that the Site will be uninterrupted, error-free, or secure.
9. Limitation of liability
To the maximum extent permitted by law, FamilyInsured shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the Site, regardless of cause or legal theory.
10. Binding arbitration & class-action waiver
Please read this section carefully — it affects your legal rights.
You and FamilyInsured agree that any dispute, claim, or controversy arising out of or relating to these Terms, the Site, or any communications you receive as a result of submitting your information (including disputes under the Telephone Consumer Protection Act) shall be resolved by final and binding individual arbitration, rather than in court, except that either party may bring an individual claim in small-claims court if it qualifies.
The arbitration shall be administered by a recognized arbitration provider under its applicable consumer arbitration rules. The arbitrator shall have exclusive authority to resolve any dispute relating to the interpretation, applicability, or enforceability of this agreement to arbitrate.
Class-action waiver: you and FamilyInsured agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding. The arbitrator may not consolidate more than one person's claims and may not preside over any form of class or representative proceeding.
Opt-out: you may opt out of this arbitration agreement by emailing support@yourfamilyinsured.com within 30 days of first accepting these Terms, stating your name and your intent to opt out of arbitration. If any portion of this Section is found unenforceable, the remainder shall remain in effect, except that if the class-action waiver is found unenforceable, this entire arbitration Section shall be void.
11. Governing law
These Terms are governed by the laws of [STATE — confirm with operator], without regard to its conflict-of-law principles. Subject to the arbitration provision in Section 10, any disputes that proceed in court shall be brought in the state or federal courts located in that state, and you consent to their jurisdiction.
Note: the governing-law state above is a placeholder and must be set to FamilyInsured's actual state of formation/principal place of business before publication. Do not rely on this clause until the bracketed value is filled in.
12. Changes to these Terms
We may update these Terms from time to time. The "Effective" date at the top reflects the most recent revision. Continued use of the Site after changes are posted constitutes your acceptance.
